Terms of services

When are the ToS applicable?

By ordering any product or service from Crocuda_vps, these Terms of services are agreed by both parties:

  • Crocuda_vps

and

  • Customer, Any natural or legal person, individual or professional, private or public, wishing to engage in the services provided by Crocuda_vps,
Please note that these terms of services may be modified at any time. It is therefore advisable to review them regularly.

Responsibility

Crocuda_vps directly provides the hosting of services but cannot be held not responsible for data hosted on the **customers**’s VPS, their content or their use by internet users.

Crocuda_vps is not responsible for the content broadcast by its customers, and the cutomer guarantees to have the rights to broadcast the content.

When the customer orders their VPS, they confirm that they have the necessary knowledge to manage it.

Data Protection

In accordance with the Data Protection Act of January 6, 1978, you have the rights to query, access, modify and oppose personal data concerning you.

To oppose and modify, your personal data, simply change the environment variables that you usually send when connecting over ssh to the TUI.

Liability

Crocuda_vps does not take the responsibility in any way for the loss of profit of Customers nor any other economic loss, caused by direct or indirect use of Crocuda_vps services,

as well as possible incorrect or outdated information that may be found on crocuda.com website.

Service Interruption

Crocuda_vps reserves the right to suspend its operation for maintenance or other reasons and will inform its Customers on as much as possible, without being held to any guarantee or compensation, regardless of the nature of the damages suffered by the Customer.

We still are in alpha so there is some regular downtimes due to planned cold updates. Expect your VMs to be rebooted between 1/month to 1/week.

Crocuda_vps’s responsibility cannot be called into question in case of the customer’s fault, negligence, or failure, in the event of an incident beyond Crocuda_vps’s control, in case of illicit password disclosure or use, or misuse of the terminal by the Customer.

Crocuda_vps’s responsibility cannot be called into question in case of partial or total destruction of transmitted or stored information.

Crocuda_vps does not perform any backups of data stored on VPS.

Service Delivery

Services are delivered to the account on which the Customer placed the order.

The Customer must check the status upon delivery of the service or goods and report any damage or inconsistency with the order.

Once the service is used, no refund can be claimed,

So, when experimenting with the services to see if it fits you, be sure to top-up your account with small amounts.

Use and Abuse

Be free to use and abuse any computing resources you paid for (CPU, RAM, storage, bandwidth, throughput...) 🤗.

Crocuda_vps reserves the right to throttle resources usage for Customers to have equitable resource availability when simultaneously using a common resource.

Obligations

Crocuda_vps obligations

The order will be executed no later than 48 hours from the day following receipt of payment. These times may vary depending on the number of internal orders to process and the volume of available servers.

Crocuda_vps commits to maintaining the host servers in good working order and keeping them up to date.

To maintain a reliable and efficient infrastructure, Crocuda_vps reserves the right to interrupt services to perform maintenance.

Customer obligations

The Customer declares to fully accept all legal obligations arising from the ownership of their services, with Crocuda_vps not being sought or troubled in this regard for any reason, especially in the event of violations of laws or regulations applicable to the Customer’s services.

Content

Confidentiality

Data stored on VPS remains confidential, and Crocuda_vps commits to keeping it confidential.

However, under judicial requisition, Crocuda_vps will be required to provide the requested information.

Illegal use

Crocuda_vps’s network and services can only be used for legal purposes. It is strictly prohibited to store, distribute, or transmit the content that violates any applicable domestic or foreign law.

Crocuda_vps cannot accept the storage of data that is

  • child-pornographic,
  • defamatory,
  • or contains illegal data, or content with video files or any other document that constitutes threats or disrupts the proper functioning of the servers.

Malware

Besides, the Crocuda_vps services may not be used to distribute, store, or transmit any virus, Trojan horse, worm, or any other content that may cause harm to network, equipment, or to other users.

Crocuda_vps reserves the right to suspend the customer’s service if it poses a danger to the proper functioning of the infrastructure.

Scam

Customers are not allowed to use the Crocuda_vps network or services to store or deliver the content that can be labeled as fraudulent or misleading, for the purposes of promoting deceptive services or products.
